Terms and Conditions
Introduction
Roadway Movers LLC (“Roadway Movers”) is a fully licensed and bonded auto transport broker with the U.S. Department of Transportation. These Auto Shipping Service Terms and Conditions (the “Agreement”) govern the services (the “Services”) provided by Roadway Movers to you, the client (“you” or the person(s) you designate, referred to as “Client”).
Acceptance of Agreement
By accepting or agreeing to this Agreement, you confirm that you have read, understood, and agree to be bound by all terms herein. This Agreement constitutes the sole understanding between you and Roadway Movers, except as otherwise explicitly stated.
Services
Roadway Movers acts solely as an auto transport broker, connecting you with a carrier for transporting your vehicle(s). We do not transport your vehicle ourselves, nor do we take possession of it. Roadway Movers will identify and contract with a transport carrier (“Carrier”) to handle the transport of your vehicle in accordance with your order. Our Services are considered complete once we have designated a Carrier to transport your vehicle.
Fees
You agree to pay all fees for Services and any additional charges that may arise, including for extra luggage or personal property. Payment must be made via credit/debit card or Zelle at the time of booking. By placing an order, you authorize Roadway Movers to charge your payment method immediately. The fee details will be outlined in the contract sent to you via verification email. Please note that the quoted price is an estimate and may change due to unforeseen circumstances.
The remaining balance and any additional charges must be paid in full by cash, money order, or certified check directly to the Carrier upon delivery. Failure to pay the remaining balance will result in your vehicle being stored at your expense until the balance is settled. All fees are non-negotiable and must be paid in full.
General Refunds or Order Cancellations
You may modify your order before your vehicle is picked up. Note that changes may incur a fee of $100. If you cancel your order before a Carrier is assigned, a processing fee of 50% of your deposit will be deducted, with the remainder refunded to your original payment method. If you cancel after a Carrier has been assigned, a 100% cancellation fee applies due to the allocation of resources and potential loss incurred. Orders cannot be changed or canceled after the vehicle has been picked up. Requests for changes or cancellations must be submitted in writing to info@roadwaymoversllc.com or to your assigned representative.
Placing an Order
To place an order, provide accurate information about your vehicle, its operability, pickup and delivery addresses, preferred pickup date, and contact information for individuals at both locations. You will receive a “Verification Email” with your order details and fees. Review and confirm the information and acceptance of the fees.
You will be notified by email when a Carrier has been assigned, including details about the Carrier and estimated pickup and delivery dates. Roadway Movers cannot guarantee a specific driver or Carrier.
Carrier Responsibilities
The Carrier will make reasonable efforts to contact you before pickup or delivery to provide approximate timing and location. They will aim to be as close as possible to your requested address, but alternative locations may be necessary due to transportation restrictions. If the Carrier cannot access residential areas, they will use a nearby commercial location. You must appoint someone to handle the delivery if you are unavailable.
Vehicle Preparation
Inform Roadway Movers and the Carrier about any luggage or personal property, ensuring it does not exceed 100 lbs. The Carrier is not liable for damages caused by excessive or improper loading. Ensure your vehicle is in working condition, with 1/4 to 1/2 tank of fuel, and that any alarm systems are disarmed. Remove all personal items and hazardous materials from the vehicle. Roadway Movers and the Carrier are not responsible for damages or losses due to non-compliance with these guidelines.
Transport of Vehicle
By accepting the order, you authorize the Carrier to transport your vehicle and perform necessary actions to complete the transport, including driving the vehicle if needed. The Carrier’s responsibility begins with the signing of the Bill of Lading (BOL) at pickup and ends with the signing of the BOL at delivery or upon receipt of the vehicle. Ensure to complete a thorough inspection and sign the BOL at delivery to preserve your ability to file a damage claim.
Transportation services may be subject to delays due to factors beyond our control, including road conditions, weather, and mechanical issues. Neither Roadway Movers nor the Carrier guarantees specific pickup/delivery dates or times.
Arrangement
We strongly advise you or your designee to be present at pickup and delivery locations. Failure to do so may waive your rights under this Agreement, including inspection and notation of damage. In such cases, Roadway Movers is not liable for damage or loss, and you may need to sign additional releases or make alternative arrangements.
Insurance
Carriers are legally required to maintain insurance covering liability. Trucking damage claims are covered by the Carrier’s insurance, with coverage ranging from $100,000 to $250,000 for cargo and a minimum of $750,000 for public liability and property damage. Claims must be noted at delivery and submitted in writing within 15 days. Roadway Movers does not guarantee insurance coverage but will rely on documents provided by the Carrier or relevant authorities. All fees must be paid in full, and claims for damages should be filed in accordance with this Agreement.
Miscellaneous
Roadway Movers reserves the right to cancel any order or terminate this Agreement at any time for any reason without liability. Cancellations due to events beyond our control, including natural disasters or government actions, are included. This Agreement is governed by the laws of the State of California. The Client agrees to indemnify Roadway Movers and the Carrier for any costs arising from a breach of this Agreement. To ensure optimal service, do not engage other brokers or carriers for the same shipment. If we provide evidence of other broker engagements, the quoted price may be invalidated, and the deposit may be forfeited.
Agreement
By accepting these terms, you authorize the transportation of your vehicle as described.
